Description

TickBase supports the online exchange of data and knowledge related to ticks and tick-borne disease. TickBase serves as an aggregator and central searchable catalog of resources from external publishers as well as a canonical data repository for researchers needing to share new resources related to ticks, tick-borne disease, and related concepts. TickBase embraces the FAIR principles of Findability, Accessibility, Interoperability, and Re-usability (FAIR) and is committed to open access and open science.

For purposes of these Terms of Use for TickBase (“Terms of Use”), TickBase is operated by the University of Idaho in collaboration with the University of Nevada, Reno; Dartmouth College, and the University of New Mexico as part of a National Science Foundation (NSF) Established Program to Stimulate Competitive Research (EPSCoR) Award Number 2019609

The member TickBase institutions are separate legal entities and are severally (but not jointly) liable for their respective obligations hereunder.

 

Intellectual Property Rights - Licenses

You are encouraged to use TickBase to benefit yourself and others. By using this repository and any of the materials made available through TickBase (the “Works”), you agree to be bound by these Terms of Use.

 
You are permitted to use the Works, subject to your compliance with certain license terms. New submitted resources not derived from third-party sources will be copyrighted by TickBase, unless specifically noted to the contrary. Resources harvested from third party publishers remain under their original copyright and TickBase makes no claim for additional copyright for resources harvested from third party publishers.

The majority of Works in TickBase are licensed under one of the following public licenses: (1) the Creative Commons Attribution 4.0 (CC BY 4.0), (2) the Creative Commons Attribution 3.0 IGO (CC BY 3.0 IGO) or (3) the Creative Commons Attribution NonCommercial NoDerivatives 3.0 IGO (CC BY-NC-ND 3.0 IGO).

Some Works within TickBase are not subject to the CC BY 4.0, CC BY 3.0 IGO or CC BY-NC-ND 3.0 IGO licenses, but are available under other license terms.

 

Third Party Content

In general, no matter what license applies to each particular Work, TickBase and it's member institutions do not necessarily own each component of the content included in the Works. TickBase therefore does not warrant that the use of any third-party-owned individual component or part contained in TickBase will not infringe on the rights of third parties. The risk of claims resulting from such infringement rests solely with you. If you wish to re-use a component of the Work, it is your responsibility to determine whether permission is needed for that re-use and to obtain permission from the copyright owner.

 

Attribution

You are expected to cite the original canonical publishers for all resources discovered and used within TickBase. For new resources submitted canonically to TickBase, complete attribution can be given in compliance with standard academic practices.

 

No Endorsement

You may not publicly represent or imply that TickBase, or any of its member institutions, is participating in, or has sponsored, approved or endorsed the manner or purpose of your use, reproduction, translation or adaptation of Works from TickBase. TickBase and its member institutions retain all rights to prosecute, to the fullest extent of the law, any use of the Works in a manner that falsifies, misrepresents, disparages or fraudulently uses the Works, infringes the intellectual property rights of any third party, or disparages or harms the reputation of TickBase, its member institutions, or the National Science Foundation.

 

No Association, No Use of TickBase Logo and Name

You may not use any trademark, official mark, official emblem, or logo of TickBase or any of its member institutions, or any of its other means of promotion or publicity, without prior written consent or in any event to represent or imply an association or affiliation with TickBase or its member institutions.

 

Other

These Terms of Use may be amended by TickBase from time to time at our sole discretion. Please periodically review the controlling version of these Terms of Use. By continuing to use TickBase subsequent to the TickBase and its member institutions making available an amended version of these Terms of Use, you acknowledge, agree and consent to such amendment.

 

TickBase provides other websites, services and databases that may be governed by different terms of use, as stated in the terms and conditions specific to such websites, services and databases. Please review the applicable terms of use before using any websites, services and databases provided or made available by TickBase or its member institutions. Please note that failure to comply with these Terms of Use, or with the license terms applicable to any Work, including proper attribution format or retaining copyright notices as required, may be grounds for TickBase and its member institutions to restrict or prohibit your access to TickBase. In addition, TickBase and its member institutions reserves all rights and legal remedies for those violations.

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended, entered, or created by these Terms of Use.

Nothing herein shall constitute or be considered to be a limitation upon or waiver of the privileges and immunities of any member institution of TickBase, all of which are specifically reserved.
